Free Dive Spearfishing Assumption of Risk and Release Agreement

You declare that you are experienced and proficient with the skills of freediving and related activities and equipment.

You UNDERSTAND THAT FREEDIVING AND RELATED ACTIVITIES ARE INHERENTLY DANGEROUS. Participating in these activities may expose you to risks that can result in SERIOUS INJURY, DISABLEMENT, AND/OR DEATH. Knowing this, you ACCEPT FULL RESPONSIBILITY for all consequences of your actions and expressly assume all risks of harm.

In consideration for granting permission to purchase goods from BlueTunaSpearfishing.com, you agree to the following terms and make the following warranties:

  1. You will not dive while under the influence of alcohol or drugs, or while your judgment is impaired, and you are in good physical condition and of sound mental health.

  2. You will not dive alone and will dive in cooperation with another diver with whom you have discussed the dive plan, safe diving practices, and emergency procedures.

  3. You will dive with a high-visibility locating device to indicate your position at all times.

  4. While diving, you will carry at least one emergency signaling device.

  5. You will not dive in conditions in which you do not feel comfortable or that are beyond your experience level or physical ability.

  6. You will not hyperventilate in preparation for a dive nor attempt to extend a dive beyond your personal safe limits, as doing so can greatly increase the risk of blackout, serious injury, and/or death.

  7. You will assess the conditions at each dive site, including current, swell, chop, wind, visibility, boat traffic, and other variables as they relate to your safety and that of others.

Spearguns may be loaded only while in the water and must be unloaded at all other times.
You are fully responsible for knowing and complying with all current laws and regulations as they relate to any game you may take and any gear you use.
You remain fully responsible for your safety.

Release of Liability and Covenant Not to Sue

You HEREBY FULLY RELEASE, discharge, and hold harmless Blue Tuna Spearfishing Inc., its owners, operators, affiliates, crew, employees, agents, successors, and assigns (the “Released Parties”), FROM ANY AND ALL LIABILITY, demand, claim, or right of action of any kind, for any injury or damage of any sort, to person or property, sustained by you or others, in any way arising, directly or indirectly, from or in association with Blue Tuna Spearfishing Inc., even if the liability may arise out of negligence or carelessness on the part of the Released Parties. Furthermore, you COVENANT NOT TO SUE or make any demand or claim against ANY OF THE RELEASED PARTIES. This release and Covenant Not To Sue shall be binding on yourself, your heirs, executors, assigns, and other representatives.

You HAVE READ AND FULLY UNDERSTAND THIS AGREEMENT, AND AGREE TO BE BOUND BY ITS TERMS.
